Terms & Conditions of Service
1. PREAMBLE & DEFINITIONS
- 1.1. These Terms and Conditions ("Terms") govern the purchase and use of "Welcome Packages" (Greeting Services, Flower Garlands, eSIMs, Concierge) provided by Xin Chào Việt Nam ("The Service Provider," "We," "Us") at Da Nang International Airport (DAD).
- 1.2. "The Customer" refers to the individual or entity purchasing or utilizing the services.
- 1.3. "The Service" implies the coordination of greeting staff, procurement of goods (flowers/SIMs), and airport meet-and-greet facilitation.
2. SERVICE LIMITATIONS & AIRPORT REGULATIONS
- 2.1. Restricted Areas: The Service Provider operates primarily in the Public Arrival Hall (Landside). Unless the "VIP Fast-Track" service is explicitly purchased and authorized by Immigration/ACV, our staff cannot enter the Restricted Airside Area (Immigration/Baggage Claim).
- 2.2. Meeting Point: Staff will meet the Customer at the designated arrival gate exit holding a name board.
- 2.3. Security Protocols: Services are subject to the security regulations of the Airports Corporation of Vietnam (ACV). We are not liable for service interruptions caused by sudden airport security lockdowns, badge revocations, or terminal closures.
3. BOOKING & MODIFICATIONS
- 3.1. Lead Time: Bookings must be confirmed at least 24 hours prior to the scheduled flight arrival time to ensure staffing and fresh product procurement.
- 3.2. Flight Details: The Customer is responsible for providing accurate Flight Numbers and Arrival Times.
- 3.3. Flight Changes: Changes to arrival time must be communicated at least 6 hours in advance. Failure to do so may result in a "No Show" status (See Section 6).
4. SPECIFIC PRODUCT POLICIES
4.1. Fresh Flower Garlands (The "Perishability" Clause)
- Nature of Goods: Fresh flowers are perishable natural products. Variations in color and size may occur based on seasonal availability from our partners.
- Spoilage Risk: Garlands are prepared based on the scheduled arrival time. If a flight is delayed by more than 4 hours, the freshness of the flowers cannot be guaranteed. The Service Provider bears no liability for wilted flowers due to airline delays.
- Replacement: Requesting a fresh replacement for a significantly delayed flight will incur a surcharge equal to 50% of the original flower cost (Cost of Goods Sold coverage).
4.2. eSIM & Telecommunications
- Affiliate Partnership: Xin Chào Việt Nam is proud to partner with Mobifone (https://www.mobifone.vn), a leading telecommunications provider in Vietnam.
- Sponsorship Program: eSIMs are provided FREE of charge through the "HiVietnam" program sponsored by Mobifone.
- Activation Process: Customers must download the official Mobifone application to activate their eSIM. All required registration information (including Passport identification) must be provided directly through the application in compliance with the telecommunications laws of the Socialist Republic of Vietnam.
- Liability: As the eSIM is a sponsored product from a third-party provider, Xin Chào Việt Nam is not liable for technical issues, network outages, or device compatibility problems arising from the use of the Mobifone application or network.
5. WAITING TIME & NO-SHOW POLICY
- 5.1. Standard Waiting Time: Our Greeters will wait for a maximum of 90 minutes after the actual flight landing time.
- 5.2. Extended Delays: If the Customer is detained at Immigration or Baggage Claim beyond 90 minutes, they must contact the provided hotline immediately.
- 5.3. No-Show: If the Customer does not appear within the waiting window and fails to contact us, the service is considered a "No Show." Staff will be released, and 100% of the fee is non-refundable to cover labor and material costs.
6. CANCELLATION, REFUNDS & RESCHEDULING
- 6.1. No Refund Policy: All confirmed bookings are subject to a strict No Refund policy once payment has been processed, due to the commitment of staffing and the perishable nature of our products.
- 6.2. Rescheduling: Customers may reschedule their service for a later date or time provided that notice is given at least 24 hours before the original scheduled arrival. Rescheduling is subject to staff availability.
- 6.3. Emergency Cases: In verified cases of flight cancellations by the airline, we will work with the Customer to reschedule the service to their new arrival time at no additional cost, or provide a service credit for future use.
7. PRICING & TAXATION
- 7.1. All listed prices are in Vietnam Dong (VND) or converted USD equivalents.
- 7.2. VAT Structure: In accordance with Vietnam Tax Law (2025/2026): Telecommunication goods (eSIMs) are subject to 10% VAT; Tourism and Hospitality services are subject to 8% VAT (or current prevailing rate).
- 7.3. Customers requiring a VAT Invoice (Red Invoice) must provide Tax Information at the time of booking.
8. LIABILITY & FORCE MAJEURE
- 8.1. Force Majeure: The Service Provider is not liable for failure to perform obligations due to events beyond reasonable control, including but not limited to: Typhoons/Storms (common in Central Vietnam), Floods, Pandemics, Government Prohibitions, or Airline Strikes.
- 8.2. Limitation of Liability: Our total liability to the Customer regarding any booking is limited to the total amount paid by the Customer for that booking. We are not liable for missed onward connections, lost baggage, or indirect damages.
9. GOVERNING LAW
- 9.1. These Terms shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes shall be resolved exclusively by the competent courts of Da Nang City.
